The debate over what to do with the city’s 100-plus medical marijuana collectives looks like it will finally result in some action Tuesday, when the City Council will vote on setting up a complete regulatory program.

San Jose begins taxing medical marijuana dispensaries on Tuesday, following the passage of Measure U in the last election. To help ease the transition for dispensary owners, City Hall held a seminar on Monday morning on how to calculate and pay the 7 percent tax.

The city stopped accepting tax applications from medical marijuana businesses last month, and a memo from the city’s finance director indicates there were slightly more than expected.

Having handily knocked off Dolores Carr in November’s election, District Attorney Jeff Rosen has so far delivered on his promise to make changes big and small in his department. In addition to reinstating the Cold Case Unit, Team Rosen is reinvigorating the Government Integrity Unit, a do-nothing department under Carr, which has been renamed the Public Integrity Unit and put in the hands of John Chase. Rosen also circulated a memo that bars blanket challenges on judges—a pointed (and entirely symbolic) gesture referencing one of his predecessor’s most controversial ploys.

An investigator from the district attorney’s office who has been spearheading recent raids on local medical marijuana dispensaries says every pot club in Santa Clara County is operating outside the law. Dean Ackemann, who has been responsible for obtaining search warrants for the task force that has been conducting armed raids in recent months, said that in his opinion every dispensary in the county should be shut down. “The search warrants and the investigations are not going to stop,” Ackemann vowed.

Council voted 8-3 to amend the General Plan and allow new townhouses instead of reserving land for jobs next to Santana Row. Last October, the number of local pot clubs could be counted on one hand. Now, medical marijuana collectives have sprung up in every part of the city—some more legit than others. One web directory currently lists almost 70 San Jose–based medical marijuana dispensaries.

With the San Jose City council finally taking a serious look at regulating medical marijuana this week, the District 6 councilmember could not be blamed for saying, “I told you so.”

“I hate to keep going back, but if we would have done this a little earlier, everything would have been fine,” Oliverio says.

Monday: Medical Cannabis Outreach Meeting
The first outreach meeting regarding medical cannabis collectives was held Monday night at City Hall. Even though the meeting was held late in the process, it was well attended with over 150 people. There were two main groups present: residents and collective patients. Not one person spoke against compassionate use of medical marijuana in San Jose, however, both groups agreed that the locations should be away from schools, parks, daycare centers, etc. Last October, when I initially brought this issue to the Rules Committee, I advocated that we restrict where collectives can locate and include setbacks from locations like schools, etc.

The American Red Cross and Harborside Health Center of San Jose are teaming up for the first ever pot club blood drive. Next Tuesday, June 15, Harborside will host a blood donation event at its 2106 Ringwood Ave. location from noon to 6pm.

Naveen Aggarwal, the community outreach coordinator for Harborside San Jose, says that this event marks the first time ever that the Red Cross has partnered with a medical cannabis collective.

“This is completely the first time,” Aggarwal says. “I’ve heard of it attempted in L.A. a while ago. But that didn’t have much success as far as having a lot of donors, and this is definitely the first thing of its kind with the involvement of Red Cross.”

Last week, Mayor Chuck Reed entered into a very Chamber of Commerce–friendly wager with Chicago Mayor Richard Daley: If the Sharks lose the series against the Blackhawks, a basket of the finest San Jose–made foods and beverages will arrive on Daley’s desk; if the Sharks win, Reed will be elbow deep in Eli’s Cheesecake and Vienna Beef.

And whether or not this currency is anywhere near as interesting as the classics—first-born sons or freshly shaved heads—the list Reed came up with was weak sauce.

Two San Jose medical marijuana clubs announced this afternoon that they’ve filed a lawsuit against San Jose’s City Planning, Building and Code Enforcement Department and its director, Joseph Horwedel.

Mayor Chuck Reed had originally wanted to wait until November to consider a proposal to regulate medicinal cannabis collectives. Before yesterday’s vote, Reed said he wanted to see if voters would approve a state initiative that would legalize marijuana for recreational use. But after the proposal’s author, Councilmember Pierluigi Oliverio, agreed to include some flexibility on zoning, taxes and the timing of the final City Council vote on the matter, Reed agreed to support it.

The city of San Jose issued a memo today threatening to shut down three pot clubs within the city limits if they refuse to stop selling medical cannabis for a fee.

The memo, released this afternoon by Joseph Horwedel, director of the Department of Planning, Building and Code Enforcement, stated that the department has received complaints and is in the process of investigating Pharmers Health Center Cooperative, Inc., San Jose Cannabis Buyer’s Collective and Medileaf Collective. While councilmember Pierluigi Oliverio endeavors to get Proposition 215 implemented here in San Jose by licensing, regulating and taxing medical marijuana dispensaries, there is some serious marijuana drama going down in South County. For those who haven’t been following the sticky situation in Gilroy: it’s been two months since the city council started battling to shut down Garlic Town’s one and only medical pot club.

I support an ordinance in San Jose that allows for the cultivation and sale of medical marijuana dispensaries/collectives.

Proposition 215, which was passed with voter approval in 1996,  called for the legalization of Medicinal Marijuana with 56 percent of the voters in favor. Santa Clara County supported this proposition by 64 percent. Since then, the legislature has passed SB420 which dealt with the actual implementation of Medical Marijuana.

UPDATED: City Councilmember Pierluigi Oliverio released a memo Tuesday proposing that San Jose adopt an ordinance to regulate and tax the cultivation and sale of medical marijuana at dispenseries in San Jose.

The memo, which the District 6 councilmember will speak about at next Wednesday’s Rules Committee meeting, asks the council to discuss allowing medical cannabis establishments in specifically zoned locations within the city. It also outlines his proposal for the taxation of doctor-prescribed uses of pot, most notably that all tax revenue generated would be earmarked for the police department and street maintenance.
