A proposal for a new construction fee to rake in more money for affordable housing has sharply divided the City Council. Vice Mayor and 2014 mayoral candidate Madison Nguyen and Councilman Don Rocha say San Jose desperately needs another funding source for low-income housing since the state-ordered end of Redevelopment Agencies (RDA). But councilmen Pete Constant and Johnny Khamis strongly disagree. Other issues at Tuesday’s City Council meeting include a public hearing to raise the medical marijuana tax and a fight over a recycling facility near the San Jose Flea Market.

Kathleen King expressed concern earlier this year to Working Partnerships USA policy director Bob Brownstein that the city of San Jose would stop funding the Children’s Health Initiative (CHI) after Measure A passed in the 2012 election. As executive director of the the Santa Clara Family Health Foundation, King realized this would have an adverse effect on the foundation’s ability to continue operations. A plan was then set in motion to tap trusted elected officials.

As lawmakers around the county urge Congress to create a constitutional amendment to overturn the controversial Citizens United decision, the City Council on Tuesday may vote in favor of supporting a resolution to overturn the landmark U.S. Supreme Court case. Other items on Tuesday’s agenda include lawsuit settlements, a new contract for Microsoft software and state taxes.

City officials admit that San Jose’s IT department tails behind other Silicon Valley municipalities, and to change that they want a new department head. In questions geared toward candidates applying for the role of chief information officer, the City Council asks how the applicants plan to make San Jose more competitive and how to improve data access to the public. Other items on Tuesday’s San Jose City Council agenda include a $10 million airport taxiway proposal, a resolution supporting a ban of flavored tobacco sales in San Jose and a possible bump in fees for developers.

San Jose’s Elections Commission received complaints last year about political candidates exchanging coffee for signatures on a nomination petition, raising money after the election to pay off campaign debt and mingling primary and general election funds. In response to some of these complaints, the city wants to update its campaign and ethics provisions, Title 12. A public meeting will be held March 28 at City Hall.

The District Attorney’s investigation into George Shirakawa Jr. has some new paperwork to add to the pile, as discrepancies may have been found Monday in forms the former county supervisor filed during and after his time as a member of the San Jose City Council in the late 90s and early 2000s. The City Clerk’s Office began making copies of forms for the DA when San Jose Inside’s inspection of “Friends for George Shirakawa Jr.” campaign forms found inconsistent signatures from previous campaign treasurers Shirakawa employed for his 1998 council re-election campaign and officeholder account.

The San Jose Public Libraries Commission wants the city to extend a parcel tax to avoid laying off 53 of its 314 full-time library employees. Other matters going before the Rules and Open Government Committee on Wednesday include a memo from councilmembers Don Rocha and Xavier Campos in support of immigration reform, a report on budget priorities and a letter slamming George Shirakawa and anyone else who eats on the public dime.

First came a ban on smoking in public places; now local lawmakers are targeting a particular style of cigarettes. Seeing that menthol smokes are so popular with youngsters, especially minorities, several city officials want to support a Food and Drug Administration resolution that proposes banning the sale of menthol cigarettes. The motion brought by councilmembers Kansen Chu, Ash Kalra and Xavier Campos goes before the Rules and Open Government Committee Wednesday.

San Jose released its annual list of city salaries late last week, reminding us once again where the bulk of the municipal budget goes. Like most municipalities, payroll accounts for the city’s single highest expense. San Jose shelled out $596 million, or 62 percent of this fiscal year’s budget, on payroll for its 5,500 employees. This year, retired Sgt. John M. Seaman topped the list, receiving total compensation in the amount of $308,345.

A phone survey found that San Jose residents wouldn’t mind paying more taxes if it improved public safety and city services that have been cut in recent years. City leaders will hear a report of those findings at Tuesday’s City Council meeting. Also on Tuesday, the council will discuss a disputed $350,000 bonus for Team San Jose and whether or not to join San Francisco’s Prop 8 amicus brief that is going before the U.S. Supreme Court.
